Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Background/ObjectiveSocial skills are essential in adolescence, both for their relational dimension and for their influence on other areas of adolescent life, so it is essential to include Social skills in the formal education of students.MethodThis paper presents the results of an experimental mixed factorial design pilot study in which an Interpersonal Skills Training Program for Adolescents was applied. The convenience sample consisted of 51 adolescents. An evaluation was carried out before and after the intervention, using the CEDIA and SAS-A questionnaires.ResultsThe (...) mixed factorial ANOVA show significant differences in the overall measures and in most of the subscales of both questionnaires, indicating that PEHIA is effectiveness, at least in the short term.ConclusionsThe results obtained in assertiveness, interpersonal relationships and public speaking suggest that the program is feasible and shows promising results in reducing anxiety. The central aim of this paper is to explain how protocol sentences establish a specific space for scientific discussion at the level of observation in the social sciences. In this space, the four levels of the theory of protocol sentences work as a coordinate system that allows to specify the degree of quality of data production. To do so, we elaborate upon Jean-Claude Passeron’s epistemology by combining it with Otto Neurath’s theory of protocol sentences. We start by discussing Passeron’s interpretation (...) of Neurath’s work in Le raissonnement sociologique and then present Neurath’s theory, following Thomas Uebel’s interpretation, with the purpose of developing the potential of Passeron’s epistemology in this regard. Boris Vian crée son hétéronyme Vernon Sullivan en 1946. Or, leurs romans s’inscrivent dans des sous-genres discursifs bien distincts. Dès lors, peut-on parler de deux romanciers pour une même plume? Quel rôle joue le genre et son impact endigue-t-il tout point de rencontre? Au contraire, existe-t-il, malgré tout, des liens intertextuels entre les deux œuvres? Ces questions résultent d’une rencontre entre trois recherches doctorales qui a permis de croiser un concept (l’hétéronymie) à une méthode (la logométrie). Pour répondre à ces (...) questions linguistiques, cet article déroule en effet le protocole méthodologique de la logométrie et propose des premiers éléments de réponse. Pour réaliser cette étude, notre corpus contraste les romans de douze auteurs contemporains et proches génériquement des romans de Boris Vian et de Vernon Sullivan. Ce corpus est disponible sur le logiciel Hyperbase (développé au laboratoire Bases, Corpus, Langage UMR 7320). This article studies the conceptions of the interior of the Earth held by Portuguese elementary school children and senior citizens. Several studies were conducted regarding conceptions related to Earth sciences, such as rocks, minerals, earthquakes geological time, and Earth structure. Most of these studies involved students enrolled in compulsory education, some involved higher education students, several involved teachers, and only a few involved adults. The majority of the results showed that many misconceptions are held by people of all ages. Similar (...) results were found in this study, as both children and senior citizens revealed several misconceptions. The research resorted to a questionnaire based on a drawing task so as to find out the way that children and senior citizens imagine the structure and composition of the interior of our planet. A comparison between children’s and senior citizens’ drawings was made, as well as a comparison between those drawings and the historical models of the internal structure of the Earth. We found that only a small number of children and even a smaller number of senior citizens recognize that the interior of the Earth is organized in concentric layers. They assume that soil and water are a common part of the internal composition of our planet. Similarities between the drawings and the historical models were identified, particularly similarities related to Gautier’s model, which accepts the possibility of the existence of life in the interior of the planet as it happens on its surface. Fundamentación: el desarrollo de la cultura profesional docente colaborativo se sustenta en los postulados vigotskianos, donde se concibe al profesor como un sujeto comprometido con las demandas y exigencias de la sociedad. Objetivo: socializar las categorías de análisis que se deben tener en cuenta en un colectivo docente para el desarrollo de una cultura profesional colaborativa en el proceso de formación del profesional de la educación superior. Método: se realizó un estudio etnográfico en la Universidad José Martí Pérez, de Sancti (...) Spíritus, apoyada en la metodología cualitativa y un grupo de técnicas posibilitó la recogida de la información. Resultados: se obtuvieron las categorías de análisis que están estrechamente asociadas al deber ser de un docente universitario, portador de esta cultura. Conclusiones: a partir de la coincidencia de criterios sobre los aspectos teóricos y la reflexión colectiva emergieron elementos indispensables en un colectivo para lograr la cultura profesional docente colaborativa a la cual se aspira, elaborados al tener en cuenta su estructura de contenido y forma. Background: the development of collaborative professional teaching culture is based on Vigotskian statements, where the teacher is seen as an individual compromised with the demanding and needs of the society. Objective: Socialize the analytical categories that should be taken into consideration in a teaching staff for the development of collaborative professional teaching culture in the process formation of the professional of higher education. Method: an ethnographic study was carried out in the University José Marti Pérez, from Sancti Spiritus, based on a qualitative methodology and a group of techniques that make data collection possible. Results: The analytical categories obtained were closely linked to the requirements of a university teacher that has this culture. Conclusions: starting from common criteria about theoretical aspects and group reflection, vital elements emerged in the teaching staff to get the collaborative professional teaching culture that is needed, elaborated taking into account its structure of content and form. However, this concept has not been sufficiently developed, neither in the area of moral philosophy nor in bioethics. For this reason, it is necessary to define and analyze the conceptual framework in which the notion of vulnerability has been developed within the scope of bioethics. Thus, the purpose of (...) this paper is to indicate how the concept of vulnerability in the field of bioethics has been developed and what the main problems that derive from this approach are. Secondly, the paper analyzes some of the main philosophical approaches that I consider should be articulated in the expansion of a critical bioethics approach focused on the notion of vulnerability. To address this issue, I analyze the reflections that we find in the work of Martha Fineman, emphasizing the main relevant aspects for bioethics. Finally, I highlight the main implications of a theory of vulnerability for bioethics. | : Le concept de vulnérabilité est au coeur des développements actuels de la bioéthique, non seulement en raison de sa nature analytique, mais aussi en raison de son potentiel critique. Research on individual differences in facing the COVID-19 pandemic seems to be crucial in order to design diverse and highly effective intervention strategies. This study uses a sample of 302 North American participants who were recruited through the crowdsourcing platform ProA; different profiles were established, profiling variables of interest in facing the COVID-19 outbreak. Socio-demographic and psychological (personality traits, gratitude, life purpose, and religiosity) variables were explored. Summary This paper aims to bridge anthropological and cognitivist research undertaken by Gilbert Durand and Mark Johnson, who studied the phenomenon of meaning making in a similar way, although they had to use different terminology as their disciplines demanded. Durand established systematization for analyzing symbolism by taking into account the position of the body and the perceptions determining the underlying schemata of symbols. Two decades later, Mark Johnson described image schemata as gestalts having an internal structure derived from bodily perceptions. (...) Owing to these similarities, a comparison between Durand and Johnson’s theories is offered first. In the second place, I reviewed the cognitive value of the anthropological regimes of imaginaire described by Durand. During the analysis, the terminology used by these theorists (like ‘image schemata’ or ‘axiomatic schemata’) was comparatively analyzed to find common ground between their positions. In conclusion, the need for recovering theories of imagination proposed by heterodox scholars like Durand is highlighted, since they anticipate the role of images and imagination not only in language, as Johnson demonstrated, but also in the formation of anthropologically relevant symbols, which are of interest for the analysis of literature and other arts. BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

This book explores the phenomenon of creativity and creation from a psychoanalytic point of view, focusing on understanding the psycho-emotional dynamics underlying the artistic creative activities, such as theatre, literature, and painting. Throughout, Delgado considers these works of art through a Bionian, Kleinian and Freudian lens. Daniel García Delgado presenta los debates en torno a las distintas propuestas para una estrategia nacional de desarrollo con equidad en Argentina. El autor propone un análisis en cuatro dimensiones. En primer lugar, comenta los indicadores macroeconómicos positivos tras de 3 años de recuperación económica desde la crisis de 2001-2002. Sin embargo, advierte sobre algunas «luces amarillas» que han surgido en el camino, y las cuales se relacionan con el aumento de la pobreza, la distribución del ingreso y la (...) evolución del mercado del trabajo. En segundo lugar, plantea la existencia de una brecha resistente, cuyas dimensiones (social, espacial y temporal) se asocian al modelo de concentración de capital y a la excesiva centralización de las tres últimas décadas. En tercer lugar, el autor discute que la modificación de estas tres falencias implica otras medidas, objetivos y valores políticos necesarios para constituir un proyecto de desarrollo enteramente construido, sostenible e inclusivo. Las altas tasas de cambio, el superávit comercial y el impuesto a la exportación de materias primas, constituyen políticas económicas necesarias pero no suficientes. Un proyecto inclusivo del desarrollo, necesariamente debe diferir del reciente pasado neoliberal, e implica algunas dimensiones claves como: i) la definición y la especialización en un perfil productivo; ii) el papel asignado al Estado; iii) el marco regional y global del proyecto y; iv) la coalición social que lo defenderá y sostendrá. Es necesario, por último, promover una asociación entre las orientaciones y los valores políticos. En la víspera del bicentenario de la independencia argentina, las metas nacionales deben establecerse no sólo respecto del crecimiento económico, sino especialmente de la reducción del desempleo, la pobreza y la injusticia. In this paper I argue against Simion’s (2018) Epistemic Limiting Procedure for conceptual engineering and put forward a more permissive alternative, according to which epistemic losses do not systematically block amelioration, but merely provide reasons against it. On this less restrictive view, epistemic losses will be permissible, provided that they are compensated by the non-epistemic gains of the amelioration. After fleshing out the details of my proposal, I discuss two case studies in relation to which Simion’s restrictive procedure seems to (...) yield the wrong predictions. This special issue explores the relevance of shame to feminist theory and practice. Across a number of contexts, theoretical frames, and disciplines, the articles collated here provide a stimulating engagement with shame, posing questions and developing analyses that have a direct bearing on feminism. For, the significance of shame to feminists lies in the complex and often troubling implications it holds as a feeling that may be experienced differently by people of certain genders (and none), and in its relation to (...) power. Indeed, as the contributions to this special issue highlight, shame may play a role in our moral development, but given its often readily acknowledged harmful effects, shame is frequently put to politically problematic and morally questionable ends. In patriarchal societies the outgrowths of this regularly entail gendered consequences, as gendered shame may form a disciplining device operating through structures of oppression, such as gender, but also class, race, ethnicity, sexuality, nationality, and related intersectional categories. The question of a politics of shame therefore arises in the context of a consideration of the social and political deployment and manipulation of shame, and the reported divergence in the shame experience itself, which feminists have attributed to its manifestation through, among others, gender. Projectibility has traditionally been given a prominent role in natural kind theories. However, where most of these theories take projectibility to be a necessary but insufficient feature of natural kinds, this paper defends an account of natural kinds according to which the naturalness of kinds is to be identified with their degree of projectibility only. This view follows thus the path opened by Häggqvist (2005), although it goes significantly further on two main respects. First, I develop and discuss two important (...) dimensions of projectibility that are overlooked in Häggqvist’s work. In the field of clinical practice, there does not seem to be too much contention about what schizophrenia is, at least from a high level. After all, there are various diagnostic systems and guidelines, all of which point toward schizophrenia as a psychotic syndrome which likely forms a continuum with other psychotic disorders. It may sound obvious that, according to the current definitions, the major commonality between schizophrenia and all other psychoses is psychotic symptoms; more precisely, delusions and hallucinations. In this article, I give a counterexample to a claim made in that empirically equivalent theories can often be regarded as theoretically equivalent by treating one as having surplus structure, thereby overcoming the problem of underdetermination of theory choice. The case I present is that of Lorentz's ether theory and Einstein's theory of special relativity. I argue that Norton's suggestion that surplus structure is present in Lorentz's theory in the form of the ether state of rest is based on a (...) misunderstanding of the role that the ether plays in Lorentz's theory, and that in general, consideration of the conceptual framework in which a theory is embedded is vital to understanding the relationship between different theories. Patients with psychotic disorders experience a range of reality distortions. These often include auditory-verbal hallucinations, and thought insertion to a lesser degree; however, their mechanisms and relationships between each other remain largely elusive. Here we attempt to establish a integrative model drawing from the phenomenology of both AVHs and TI and argue that they in fact can be seen as ‘spectra’ of experiences with varying degrees of agency and ownership, with ‘silent and internal own thoughts’ on one extreme and ‘fully (...) external and clearly audible voices’ in the absence of a speaker on the other. We believe a spectral model will add emphasis to the continuity of experience and help to better understand how one type of psychotic symptom may interact with another, and put forward the argument that the experience of TI itself is not sufficient to classify as a delusion. In addition we aim to discuss some of the conceptual issues surrounding AVHs and TI with first-person accounts and current philosophical and neuropsychological theories in mind. We propose that the mechanisms behind AVHs and TI are more complex than source-monitoring deficits; indeed, to understand such phenomena one must appreciate that their very ‘existence’ and ‘reality’ as experienced by the individual have much deeper implications and meaning, both philosophically and clinically.
